Welcome to Barger Watch Company (“Company,” “we,” “our,” or “us”). By accessing this website and/or purchasing products from us, you agree to be bound by the following Terms and Conditions. You acknowledge that your agreement to these Terms constitutes a material condition and essential inducement to the Company’s provision of products and services, and that absent such agreement, the Company would not provide access to the website or sell its products. Please read these Terms carefully before making a purchase.

 

1. GENERAL TERMS

By using this website and/or purchasing from us, you confirm that you are at least the age of majority in your jurisdiction and agree to comply with all applicable laws and regulations.

 

We reserve the right to update, modify, or replace any part of these Terms at any time. Continued use of the website constitutes acceptance of those changes.

 

2. PRODUCTS AND ORDERS

We strive to ensure all product descriptions, images, and pricing are accurate. However, we do not guarantee that all information is error-free. We reserve the right to correct any errors and to cancel or refuse any order at our discretion. All products are sold subject to availability.

 

3. PRICING AND PAYMENT

All prices are listed in USD and all transactions on this site will be processed in USD.

We accept major credit cards and other payment methods as displayed at checkout. By submitting payment information, you represent and warrant that you are authorized to use the selected payment method.

 

4. RETURN AND REFUND POLICY

We are committed to customer satisfaction and offer a 30-day return policy for eligible items only, under the following conditions:

 

4.1 Return Window

You may request a return within 30 days of delivery.

 

4.2 Return Authorization

All returns require a Return Authorization (RA) number. To request an RA number, contact: service@bargers.com

Returns submitted without an RA number may not be accepted.

 

4.3 Condition of Items

To be eligible for a return:

• The item must be unworn and unused

• In original condition

• With all original packaging, tags, and accessories included

• The item is not customized or a special order item

Items not meeting these conditions will not be eligible for a refund.

 

4.4 Return Shipping

Return shipping applies only to eligible items, which excludes all customized, bespoke, or altered products.

Customers are responsible for all return shipping costs. We strongly recommend using a trackable and insured shipping method.

The RA number must be clearly displayed on the return package.

Items that are not eligible for return, including customized or altered watches, should not be sent back, as they will not be accepted or refunded.

 

4.5 Refund Processing

Once your return is received and inspected:

• Approved refunds will be issued to the original payment method

• Please allow up to 7 business days for processing after inspection

 

5. NON-REFUNDABLE FEES (IMPORTANT)

A 5% processing fee applies to all refunds for orders paid by credit card.

This amount represents non-refundable transaction fees incurred by Barger Watch Company at the time of the original payment. By placing an order, you expressly acknowledge and agree that 5% of the total amount charged is non-refundable, regardless of the reason for the refund.

These fees are assessed by payment processors upon completion of the transaction and are not recoverable. Accordingly, this portion of the payment will not be returned under any circumstances in the event of a refund.

 

6. FINAL SALE AND NON-RETURNABLE ITEMS

The following items are not eligible for return or refund under any circumstances:

• Customized or bespoke watches, watch dials, watch hands, or any other customized components

• Any item that has been modified, sized, or altered

• Items returned after the 30-day return period

All sales of customized or personalized products are final. Once work has commenced on any customized or bespoke item, the order becomes non-cancelable and non-refundable, regardless of stage of completion.

 

7. NO REFUNDS AFTER 30 DAYS

After 30 days from delivery, all sales are considered final and non-refundable, regardless of reason.

 

8. CANCELLATIONS AND WORK IN PROGRESS

Orders for customized, bespoke, or made-to-order items may only be canceled prior to the commencement of work.

Once design, production, assembly, or any form of work has begun on a customized or bespoke item, the order becomes non-cancelable and non-refundable, regardless of the stage of completion.

By placing an order for any customized or bespoke product, you acknowledge and agree that:

• Work may begin shortly after the order is placed

• Materials, labor, and production resources are allocated immediately

• The order cannot be canceled once work has commenced
   

Any request to cancel after work has begun will be denied, and no refund will be issued under any circumstances.

 

9. CHARGEBACK POLICY

By completing a purchase, you agree to contact Barger Watch Company directly to resolve any issue prior to initiating a chargeback or payment dispute.

You acknowledge and agree that:

• These Terms and Conditions constitute a binding agreement

• Your agreement to these Terms may be used as evidence in any dispute

• You are required to follow all return and refund procedures outlined herein

We reserve the right to dispute any chargeback where:

• The return process was not followed

• The item was delivered as described

• The claim is inconsistent with these Terms and Conditions

We may provide payment processors with all relevant documentation, including proof of delivery, order confirmation, communications, and evidence of acceptance of these Terms.

 

Improper or fraudulent chargebacks may result in:

• Denial of future purchases

• Recovery of losses, fees, and associated costs, including reasonable attorney’s fees

 

10. WARRANTY

Please refer to our separate Warranty Policy for details regarding coverage and claims.

11. LIMITATION OF LIABILITY

To the fullest extent permitted by law, Barger Watch Company shall not be liable for any indirect, incidental, or consequential damages arising from the use of our products or website.

 

12. GOVERNING LAW, DISPUTE RESOLUTION, AND JURISDICTION

These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of Texas.

 

12.1 Binding Arbitration

Any dispute, claim, or controversy arising out of or relating to these Terms and Conditions, your purchase, or use of this website (collectively, “Disputes”) shall be resolved exclusively through final and binding arbitration, rather than in court, except as expressly provided herein.

 

The arbitration shall be administered by the American Arbitration Association (AAA) in accordance with its applicable rules then in effect. The arbitration shall take place in Williamson County, Texas, in the English language, before a single arbitrator.

 

The arbitrator shall be selected in accordance with the rules of the AAA. If the parties are unable to agree on an arbitrator, the arbitrator shall be appointed by the AAA in accordance with its procedures.

 

The arbitrator shall have the exclusive authority to resolve any Dispute, including, without limitation, any question regarding the existence, validity, enforceability, interpretation, or scope of these Terms and Conditions or this arbitration provision.

 

The arbitrator shall be authorized to award any remedies available under applicable law, subject to the limitations set forth in these Terms and Conditions. The arbitrator’s decision shall be final and binding, and judgment on the award may be entered in any court of competent jurisdiction.

 

Each party shall bear its own costs and attorneys’ fees associated with the arbitration, except as otherwise required by law or awarded by the arbitrator.

To the fullest extent permitted by law, all arbitration proceedings shall be conducted on an individual basis only and not as part of any class, consolidated, or representative proceeding.

 

12.2 Class Action Waiver

To the fullest extent permitted by law, you agree that any dispute, claim, or proceeding arising out of or relating to these Terms and Conditions, your purchase, or use of this website shall be brought solely in your individual capacity, and not as a plaintiff or class member in any purported class, collective, consolidated, or representative proceeding.

 

You expressly waive any right to participate in or recover relief under any class, collective, or representative action, whether in arbitration or in court.

 

12.3 Exclusive Venue

To the extent that any dispute is not subject to arbitration, you agree that any legal action or proceeding shall be brought exclusively in the state or federal courts located within Williamson County, Texas.

 

You hereby consent to the personal jurisdiction of such courts and waive any objection to jurisdiction or venue in such courts, including any claim that such forum is inconvenient or improper.

 

You further agree that these courts shall have exclusive jurisdiction over any such dispute.

 

12.4 Attorney’s Fees

In the event of any dispute, claim, or enforcement action arising out of or relating to these Terms and Conditions, your purchase, or use of this website, the prevailing party shall be entitled to recover its reasonable attorneys’ fees, costs, and expenses to the fullest extent permitted by applicable law.

This provision shall apply in any arbitration, court proceeding, or action to enforce an arbitration award or judgment.
